Assumption of Risk and Waiver of Liability

By making a reservation, you acknowledge the contagious nature of the COVID-19 virus and voluntarily assume the risk that you may be exposed to or infected by COVID-19 by visiting or participating activities at DeLille Cellars (“Winery”) and that such exposure or infection may result in personal injury, serious illness, permanent disability or death.  You further acknowledge that the risk of becoming exposed to or infected by COVID-19 at Winery may result from the actions, omissions, or negligence of yourself and others, including but not limited to Winery, Winery’s employees and other Winery visitors.  You voluntarily agree on behalf of yourself and all others in your group participating in the reservation (each a “Guest”) that each Guest assumes all of the foregoing risks and accept sole responsibility for any injury to themselves, including, but not limited to, personal injury, illness, disability, death, damage, loss, claim, liability, or expense, of any kind, that they may experience or incur in connection with COVID-19 exposure alleged to have occurred at Winery (“Claims”).  Each Guest hereby releases, discharges, covenants not to sue, and holds harmless DeLille Cellars LLC, DC Forecaster LLC, its affiliates, employees, agents, and representatives (“Releasees”), of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.  Each Guest understands and agrees that this release includes any Claims based on the actions, omissions, or negligence of Releasees, whether a COVID-19 infection occurs before, during, or after their visit to or participation in activities at Winery.  If any provisions of this waiver are found to be unenforceable, the remainder shall be enforced as fully as possible.
